一、
依該部114年8月12日勞動發就字第1140511448A號函辦理。
二、
依勞動部上揭函文,相關法規及宣導事項摘述如下:
  
(一)禁止刊登大陸地區勞務廣告:
  
1、臺灣地區與大陸地區人民關係條例(下稱兩岸條例)第34條第1項規定:「依本條例許可之大陸地區物品、勞務、服務或其他事項,得在臺灣地區從事廣告之播映、刊登或其他促銷推廣活動。」同條第4項規定:「第1項廣告活動之管理,除依其他廣告相關法令規定辦理外,得由行政院大陸委員會會商有關機關擬訂管理辦法,報請行政院核定之。」第89條規定:「委託、受託或自行於臺灣地區從事第34條第1項以外大陸地區物品、勞務、服務或其他事項之廣告播映、刊登或其他促銷推廣活動者,或違反第34條第2項、或依第4項所定管理辦法之強制或禁止規定者,處新臺幣10萬元以上50萬元以下罰鍰。前項廣告,不問屬於何人所有或持有,得沒入之。」
  
2、大陸委員會依前開規定訂定之「大陸地區物品勞務服務在臺灣地區從事廣告活動管理辦法」第6條第5款規定略以,未經許可之大陸地區勞務,不得在臺灣地區從事廣告活動或以置入性行銷方式為之。第12條第1項第1款規定略以,委託、受託或自行於臺灣地區從事兩岸條例第34條第1項以外大陸地區物品、勞務、服務或其他事項之廣告播映、刊登或其他促銷推廣活動,依兩岸條例第89條第1項規定,處新臺幣10萬元以上50萬元以下罰鍰。
  
(二)禁止仲介國人赴陸就業:
  
1、兩岸條例第35條第2項規定:「臺灣地區人民、法人、團體或其他機構,得與大陸地區人民、法人、團體或其他機構從事商業行為。但由經濟部會商有關機關公告應經許可或禁止之項目,應依規定辦理。」第86條第4項規定:「違反第35條第2項但書規定從事商業行為者,處5萬元以上500萬元以下罰鍰,並得限期命其停止或改正;屆期不停止或改正者,得連續處罰。」
  
2、經濟部依兩岸條例第35條第2項但書規定公告之「在大陸地區從事商業行為應經許可或禁止之事項公告項目表」,將「從事臺灣地區人民赴大陸地區就業之人力仲介業務」列為禁止類。
  
3、就業服務法第34條第2項前段規定略以,未經許可,不得從事就業服務業務。第65條第1項規定略以,違反第34條第2項規定者,可處新臺幣30萬元以上150萬元以下罰鍰。
三、
據悉中國大陸迭有透過陸商、臺商、外商或非法仲介招攬臺灣人才赴陸就業,又其中不乏有向核心重點大學招攬高科技人才之情形,對於我國科技安全及產業發展已構成潛在風險。爰為強化學校及在校學生對相關法規之認知,及避免民眾誤觸法規,勞動部業製作旨揭宣導資料(如附件),請貴校加強宣導並協助周(轉)知所屬教職員工生,俾提升法遵意識,共同維護我國關鍵人力及科技資安。另請貴校(並協助轉知轄管各級學校、附設醫院及農林場等)避免提供或出借校園教室、禮堂、操場等室內及戶外場地予各單位(包含私立就業服務機構),辦理相關活動(如:大陸就業市場說明會、招募國人赴陸就業、大陸臺商校友就業座談等),以免間接促成國內人才被不當挖角。

Forwarding one set of the Ministry of Labor’s outreach materials on “Prohibited Activities Concerning Employment in the Mainland Area.” Please strengthen publicity and inform your personnel accordingly.

Explanation:

  1. Handled in accordance with the Ministry of Labor letter No. 勞動發就字第1140511448A dated August 12, R.O.C. Year 114.

  2. Pursuant to the above-referenced letter, key provisions and outreach points are summarized as follows:

    (1) Prohibition on advertising labor services in the Mainland Area

    1. Article 34, Paragraph 1 of the Act Governing Relations between the People of the Taiwan Area and the Mainland Area (hereinafter, the “Cross-Strait Act”) provides: “Goods, labor, services or other matters from the Mainland Area that are permitted under this Act may engage in broadcast, publication, or other promotional activities in the Taiwan Area.” Paragraph 4 of the same article provides: “The regulation of the advertising activities under Paragraph 1, in addition to relevant advertising laws and regulations, may be set forth by the Mainland Affairs Council, in consultation with the competent authorities, and submitted to the Executive Yuan for approval.” Article 89 provides: “Any person who commissions, is commissioned, or on their own engages, in the Taiwan Area, in broadcast, publication, or other promotional activities for goods, labor, services, or other matters of the Mainland Area other than those under Article 34, Paragraph 1, or who violates Paragraph 2 of Article 34, or the mandatory or prohibitory provisions of the regulations stipulated under Paragraph 4, shall be fined between NT$100,000 and NT$500,000. The advertisements described in the preceding paragraph may be confiscated regardless of ownership or possession.”

    2. Under the Regulations Governing Advertising Activities in the Taiwan Area for Goods, Labor and Services from the Mainland Area promulgated by the Mainland Affairs Council pursuant to the foregoing, Article 6, Subparagraph 5 provides, in essence, that labor services from the Mainland Area not duly permitted may not engage in advertising activities or product placement in the Taiwan Area. Article 12, Paragraph 1, Subparagraph 1 provides, in essence, that any person who commissions, is commissioned, or on their own engages in broadcast, publication, or other promotional activities for goods, labor, services, or other matters of the Mainland Area beyond Article 34, Paragraph 1 of the Cross-Strait Act shall be fined between NT$100,000 and NT$500,000 pursuant to Article 89, Paragraph 1 of the Cross-Strait Act.

    (2) Prohibition on brokering employment in the Mainland Area for R.O.C. nationals

    1. Article 35, Paragraph 2 of the Cross-Strait Act provides: “People, juridical persons, groups, or other institutions of the Taiwan Area may conduct commercial activities with those of the Mainland Area; however, items announced by the Ministry of Economic Affairs, in consultation with the competent authorities, as requiring permission or as prohibited shall be handled in accordance with such announcements.” Article 86, Paragraph 4 provides: “Anyone who engages in commercial activities in violation of the proviso to Article 35, Paragraph 2 shall be fined between NT$50,000 and NT$5,000,000, and may be ordered to cease or correct within a specified period; failure to do so may result in consecutive penalties.”

    2. In the “List of Items Requiring Permission or Prohibited for Conducting Commercial Activities in the Mainland Area” announced by the Ministry of Economic Affairs pursuant to Article 35, Paragraph 2 of the Cross-Strait Act, “engaging in human-resources agency services for arranging employment of people of the Taiwan Area in the Mainland Area” is listed as prohibited.

    3. Under the Employment Service Act, Article 34, Paragraph 2 (first part) provides, in essence, that no person may engage in employment services without permission. Article 65, Paragraph 1 provides that violators of Article 34, Paragraph 2 shall be fined between NT$300,000 and NT$1,500,000.

  3. It is understood that Mainland China has repeatedly recruited Taiwanese talent to work in the Mainland through Mainland, Taiwanese, or foreign businesses, or via illegal intermediaries; among these are instances targeting high-tech talent from key universities, which has posed potential risks to our national technology security and industrial development. To strengthen schools’ and students’ understanding of relevant laws and to prevent inadvertent violations, the Ministry of Labor has produced the attached outreach materials. Please enhance publicity and assist in informing all faculty, staff, and students to raise compliance awareness and jointly safeguard our critical human resources and technology information security. In addition, please (and assist in informing subordinate schools at all levels, affiliated hospitals, and forestry/farm units) avoid providing or lending on-campus venues—such as classrooms, auditoriums, and athletic fields, whether indoor or outdoor—to any entities (including private employment service agencies) for activities such as Mainland job-market briefings, recruitment of Taiwanese to work in the Mainland, or employment talks by Mainland-based Taiwanese business alumni, so as not to indirectly facilitate the improper poaching of domestic talent.
